1. General
   These conditions apply to all sales and agreements between Noël Noël and the consumer, whereby Noël Noël will apply the Terms and Conditions unless agreed otherwise in writing. Noël Noël will ensure that the Terms and Conditions will be made available electronically. By ordering products from Noël Noël, the customer automatically accepts and agrees with the Terms and Conditions.
   
2. Orders
   Once an order has been placed, the consumer will immediately receive a confirmation e-mail with details of the order and the total costs of the order. All orders will be sent within five 3 working days after receipt of payment by the consumer. In the event of a technical malfunction, or any other circumstance beyond Noël Noël’s control, the order will be shipped as soon as possible. Noël Noël will keep the consumer duly informed of the status of the order.
   We strive to keep our website (www.noel-noel.nl) as current as possible. However, the possibility remains that a certain product is no longer available, in which case we will contact the consumer as soon as possible and discuss possibilities.
   
3. Delivery & Returns
   The delivery time is indicative and is therefore not guaranteed. The final delivery time will not exceed the indicated delivery time with more than one week, cases of ‘force majeure’ not included. The order will be shipped within three working days after receiving payment. Noël Noël cannot be held responsible if the package is not delivered to the consumer on time for causes outside of Noël Noël’s control.
   
   If the consumer, for whatever reason, does not wish to keep the product, the consumer has the right to return the product to Noël Noël within fourteen days after receiving the product. The consumer must follow all further return conditions and instructions as set out by Noël Noël. This does not apply if the product has been worn or washed, or if the consumer has attempted to mend or alter the article in any way. Returned products will only be accepted by Noël Noël if they are sent in the original, undamaged wrapping and the labels are still attached to the products.  Furthermore, the consumer must pay the shipping costs of the returned products. Under no circumstances will Noël Noël reimburse the shipping costs of returned merchandise. It is the customers responsibility that the order gets back to us, in order to return it, Noël Noël is not reliable for any problems that might occur during the shipping of the return. If the return instructions have been followed accurately, Noël Noël will reimburse the consumer for the returned article(s) within fourteen days after receiving it. If a payment is completed by creditcard, refunds will automatically be applied to the credit card used by the customer at the time of purchase.  

4. Prices and payments
   All prices indicated on Noël Noël’s website are in Euros and include value added tax. Consumers are able to make payments electronically to Noël Noël in many different ways. The differing payment methods are indicated on the website. The order will be shipped once Noël Noël has received payment of the order. Noël Noël will add the shipping costs to the invoice of the order. 
   
5. Transfer of ownership
   Ownership of the products will not be transferred until the consumer has fulfilled its obligations. When the ownership is transferred to the consumer product liability is transferred to the consumer as well.
   
   
6. Liability
   a. All products have been produced with the greatest care. Noël Noël cannot assume any liability for damages in any form whatsoever, either physical, material or immaterial, that can be caused by malfunctioning or ill use of the articles sold by Noël Noël and/or materials or accessories becoming undone.
   The content of the website has been compiled with the greatest care. However, Noël Noël cannot preclude the possibility of any error or incomplete information on the website. Noël Noël cannot assume any liability whatsoever for the consequences of incorrect or incomplete information on the website. Noël Noël cannot be held responsible for any typing or misprinting errors that could communicate an incorrect selling price. If a price on the site can be deemed as unreasonable, or as a mistake, Noël Noël is not obliged to sell the item at that price. In that case Noël Noël will adjust the price as soon as possible. Each piece is unique. The prints and color may vary slightly from piece to piece since Noël Noël is working with nature products and print fabrics. Noël Noël cannot be held responsible for these variations in prints, suede, sheepskin and beads. These can differ a little bit from the pictures on the website. Noël Noël cannot assume any liability whatsoever for any differences.
   
   
7. Queries/Complaints
   In the case of queries or complaints concerning any of our products or procedures, please inform us by e-mail (info@noel-noel.nl) You will receive a reply within three working days.
   
   
8. Force Majeure
   Despite any other established legal rights, Noël Noël is entitled, at its own choice, in case of Force Majeur, to cancel your order, or cancel the purchase agreement without legal intervention, by informing the client in writing. Client is not entitled to any damages, unless given the circumstances this would be unacceptable according to measures of reason and fairness.
   
9. Privacy
   Noël Noël finds it very important to ensure that all of the consumer’s personal information is treated with the utmost care and security. Noël Noël will not give the consumer’s personal information to third parties, except when the information is required for the delivery of the order.
   When making an order, Noël Noël requires the consumer’s name, invoice and delivery addresses, and payment details so that an order can be processed. The payment details will only be used to conclude the payment process.
   If the consumer subscribes to our newsletter their personal details will be used to keep them informed of special offers, website improvements and other relevant information pertaining to Noël Noël.
   Records of website visits are kept for statistical purposes. Information concerning the amount of visitors and visitor frequency to our website will be used for internal research and website improvement. However, this general information is anonymous and cannot be traced back to the individual visitor.
   
   
10. Governing law
    a. These Terms and Conditions and any separate agreements whereby Noël Noël provides you services and/or products shall be governed by and construed in accordance with the laws of the Netherlands.
    b. All disputes that may arise from this agreement shall be submitted to the competent court of Amsterdam.
    
    
11. Copyright
    All information on Noël Noël’s websites is protected by copyright. It is illegal to copy, use or distribute any information from Noël Noël’s website without first acquiring written permission. Visitors and users of Noël Noël’s website may not claim any rights pertaining to the information on the website. None of the text or graphics from Noël Noël’s websites may be partially or wholly copied or publicly used for printing, photocopying, faxing, overtyping, in an electronic database, or for any other reproduction purposes.
    
    
12. Acceptance of General Conditions
    All website users are required to be aware of, and to agree with, all of the above General Conditions. By placing an order with Noël Noël, the consumer automatically agrees to all of our General Conditions.
